The 17c formula is an arbitrary calculation used by insurance companies to estimate and severely cap diminished value payouts. It caps the maximum loss at 10% of the vehicle’s retail value, then applies aggressive modifier percentages that slash your payout based on damage severity and mileage. Gastley Law regularly rejects this formula by hiring independent appraisers to establish real market losses, and we are prepared to file suit in local Fulton, DeKalb, or Cobb County magistrate courts when insurers refuse to pay fairly.

Yes. Thanks to the landmark Georgia Supreme Court ruling in State Farm v. Mabry, Georgia is one of the only states where you can claim a diminished value at-fault accident recovery. This is a first-party claim filed directly against your own insurance policy. It applies even if you caused the wreck or if you were hit by an uninsured driver, provided your policy has not excluded it and your vehicle has suffered actual market value loss.

Under Georgia’s four-year statute of limitations (O.C.G.A. § 9-3-32) for property damage, you have four years from the date of the accident to file a diminished value claim or lawsuit. However, vehicle depreciation is most pronounced for newer models, so we strongly recommend initiating your claim as soon as possible after your vehicle’s repairs are completed.
